Terms and Conditions of Zolima Live

All participants are required to read the following terms and conditions before booking a Zolima Live experience (hereinafter referred to as “activity”), and considered to have full understanding of and be in agreement with such terms and conditions upon completion of their booking. 


In the event of any dispute, the decision of Zolima Limited (hereinafter referred to as Zolima) shall be final. Please contact us by email at

I. Booking of the Activity

1. Booking procedures

All participants are required to complete the online registration form. Any registration without all required information and/or successful payment will not be considered.

An order confirmation email will be sent to the registered email account upon successful payment. Should participants fail to receive the email, please contact Zolima by email at info@zolimacitymag.com.

Upon successful registration, participants shall receive an email with details of the activity, include meeting point, list of recommended equipment to bring (if any), and other remarks related to the activity. Should participants fail to receive the email, please contact Zolima by email at info@zolimacitymag.com.

Participants must be aged 6 or above to join a Zolima Live. Children aged between 6 and 12 can join the activity, provided that they are accompanied by their parent(s) or legal guardian(s), who are responsible for their safety and behaviour during the activity. We reserve the right to request for proof of age of your children. Some activities might be restricted to children of a specific age, which will be clarified when it applies.

Only Hong Kong residents (Permanent or non-permanent) can join Zolima Live. We reserve the right to request for proof of identity of our participants.

 

2. Personal Information Collection Statement

 

Once the registration process is completed, applicants’ personal data will be stored in Zolima database. Such data will be used for booking, general inquiry and promotions solely related to Zolima’s activities. Zolima do not sell, trade or disclose to any third party any information provided by applicants, unless authorised by applicants or required by the law. By applying to Zolima’s Live you agree to subscribe to Zolima’s newsletter unless otherwise stated. In such event, please notify us at any time by unsubscribing or emailing us at info@zolimacitymag.com.

Zolima reserves the right to photograph and film all activities. By completing the registration process, participants or any other persons attending the activities consent to Zolima photographing or filming participants and any persons attending the activities. Participants agree that Zolima takes full ownership of all photographs and films produced by Zolima or by a third party commissioned to do so. Participants agree that such material can be used in any functions, including without limitation in all media, or promotional materials of any kind.

 

3. During the activity, General Arrangement, Absence and Lateness

All participants are advised to arrive at the venue with the confirmation email for verification purpose at least 10 minutes before the scheduled starting time.

 

Participants are advised to arrive on time. Participants who arrive more than 15 minutes late may not be admitted to the activity. No refund of deposit or full payment will be made.

We reserve the right to alter the content of the activity, including but not limited to, change of itineraries, service providers, timing, for reasonable reasons such as but not limited to: closure of shops or other attractions, indisposition of service providers, disruptions of service by any of our service providers, or any of the force majeure events as per Section III, clause 4. If such alterations become necessary, we will make every effort to provide substitutions in kind to maintain the same quality of activity originally scheduled.

We may, at our discretion, require any participant to be excluded from an activity whose conduct or state of health is detrimental to the enjoyment of the other participants or disruptive of the guides’ ability to provide service, and we shall be under no liability to reimburse the disruptive participant for any costs incurred by such participant or by other participants as a result thereof.

 

All equipment and materials provided during the activity are by Zolima and service providers. Participants should use them with care.

 

 

II. Cancellation Policies

 

1. Arrangements during Adverse Weather, Tropical Cyclones or Rainstorms
The following arrangements will be made for the inclement weather conditions without further notice:

The activity will be automatically cancelled in the event a Tropical Cyclone Signal No. 8 or above, or a Black Rainstorm Warning Signal, is issued, within 2 hours prior to the scheduled start time of the activity, in which case we will notify you by phone, or other means such as email or SMS.

When the Black Rainstorm Warning Signal is no longer in force or the Tropical Cyclone Warning Signal has been changed from No.8 or above to No.3 or below 2 hours before the event:

(i) For indoor activities: The activity will continue as scheduled.

(ii) For outdoor activities: The activity might be cancelled. We will notify you by phone or other means such as email or SMS, no later than 2 hours prior to the scheduled start time of the activity.

Should the Tropical Cyclone Warning Signal No.8 or above, or the Black Rainstorm Warning Signal be issued during the activity, the event might continue or be cancelled. Onsite staff shall provide instructions. All participants are suggested to stay in safe areas. Participants may decide to stay in the class or to leave under safe circumstances.

2. Cancellations by participants

Cancellations shall be made by email or by phone at least 24 hours prior to the scheduled start time of the activity. Payment made will not be refundable, but you may transfer the paid booking to another person to attend in your place on the original activity.

To transfer the paid booking, participants should contact us by email stating another person’s (i) full name; (ii) phone number; (iii) and email. The transfer process shall not be accepted without complete information stated in this clause.

3. Cancellation by Zolima

We reserve the right to cancel the activity if the minimum number of participants is not met. In which case we will contact you by email at least 48 hours prior to the scheduled start time of the activity. The minimum of participants is stated for each activity.

We reserve the right to cancel any activity should our partners or service providers be in the incapacity to deliver or perform the services they are assigned to or for any technical or other unforeseen reasons enabling the performance of the activity. In which case we will notify you by phone or other means such as email or SMS, no later than 2 hours prior to the scheduled start time of the activity.

4. Reschedule or replacement of activities
Zolima will do its best to reschedule or arrange replacement of the cancelled activities, including as set out in Section II clauses 1 and Section II clause 3, but other than as provided in Section III, clause 5, at a time designated by Zolima and will notify participants accordingly.

(a) Participants should notify whether they are able to attend the rescheduled or replaced activities within 7 days after receiving such notification. Thereafter all participants who have stated their unavailability or did not notify Zolima their final decision will receive a full refund accordingly.

(b) For any cancellations made after the
7 day notification period, cancellations will be handled as stated in Section II, clause 2.

5. For any cancellation made by Zolima, including as set out in Section II clauses 1 and Section II clause 3, but other than as provided in Section III, clause 5, and should no replacement be offered, a full refund of participant’s payment will be made. Participants shall not be entitled to any further sum by way of compensation, damages or otherwise arising from said cancellation. We shall not be responsible for any additional expenses that may have been incurred by you in preparing for the activity or charges that may be charged by your bank.

 

III. Personal Safety, Insurance and Force Majeure

 

1. Participants are responsible for ensuring that they are in suitable physical condition for the activities. If in doubt of your level of physical fitness, you are advised to consult your doctor. Participants are also responsible for maintaining their safety at all times and agree to follow the safety instructions given by us and to exercise due care and attention during the activities. All activities are to be undertaken at the participants’ own risk. None of us, our employees, our partners, or service providers shall accept any liabilities or responsibilities in the event of illness, injury, death or loss or damage to personal properties of participants during the activities.

2. Please inform onsite staff and/or service providers should any participants feel any discomfort and need rest. Zolima employees and/or service providers of the activity shall only be responsible for notifying the emergency services for any accidental incidents.

3. Participants are strongly advised to purchase full personal insurance, including coverage for personal accident, death, medical expenses and emergency repatriation. We also strongly recommend that your insurance covers cancellation, curtailment, personal liability and loss of luggage and personal effects.

4. Any food or beverage consumed during a tour is at the participants’ own risk. We accept no liabilities or obligations in this regard.

5. Force Majeure: None of us, Zolima Limited employees or service providers shall accept any liabilities or responsibilities for any loss or damage to, or expense incurred by, any of the participants as a result of any cancellation, delay or extension of a tour or any change in prior tour arrangements due to war, terrorist activities, riots, civil unrest, industrial action (in each case whether threatened or actual), weather conditions, fire, flood, drought, unforeseen alterations or rescheduling to public transport schedules or any other event outside the control of Zolima Limited.

6. You agree to waive Zolima Limited of all liabilities and responsibilities, in whole or in part, for any loss, damage, injury, accident or inconvenience that may arise, whether directly or indirectly, as a result of any services provided by Zolima Limited.


IV. Confidentiality

 

1. During Zolima Live, all participants shall not disclose, use, and publish the content of the activities, including but not limited to, materials (tangible or intangible), photographs, for any non-personal purposes, including but not limited to business purposes.

 

2. Participants are allowed to take only photographs during the activities for personal purposes only.


V. General

 

1. We reserve the right to make changes to these terms and conditions from time to time without prior notice Please check this page regularly.

2. Any failure on our part to exercise any rights under these terms and conditions shall not constitute a waiver of our rights.

3. If any provision of these terms and conditions is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability will apply only to such provision or part thereof and the remaining part of such provision and all other provisions will continue in full force and effect.
